These Terms apply to all visitors, users and others who wish to access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.

By creating an Account on our service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

Purchases and Payment

Recording & Supervision of Coaching Sessions

As part of our commitment to quality assurance and professional development, Empowered Mind LLC may monitor or record coaching sessions. By using CoPilot's coaching service, you explicitly consent to your interactions with your coach being recorded and monitored for quality purposes. These recordings and session data are kept confidential and are not shared with third parties or used for marketing purposes.

Accounts

When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

Intellectual Property

The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Empowered Mind LLC. The Service is protected by copyright, trademark, and other laws of the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Empowered Mind LLC.

Third-Party Links

Our Service may contain links to third-party websites or services that are not owned or controlled by Empowered Mind LLC. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Cancellations through our support team require one business day (24 hours, not including weekends) to process remain subject to your specific agreement.

Dispute Resolution and Mandatory Mediation

Agreement to Mediate

Any dispute, claim or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to mediate, shall first be submitted to mandatory mediation. The parties agree to initially engage in good faith negotiations to resolve any dispute. If the dispute cannot be settled through direct negotiations, the parties agree to endeavor to settle the dispute in an amicable manner by mediation administered by a mutually agreed-upon mediator in Florida before resorting to arbitration or litigation.

Mediation Process

The mediation shall take place in Florida.The mediation shall be conducted in accordance with the American Arbitration Association's mediation procedures.The parties shall share the mediator's fee and any filing fees equally.The mediation shall be completed within 60 days of commencement unless the parties mutually agree otherwise in writing.All communications during the mediation process shall be confidential and treated as settlement negotiations for purposes of applicable rules of evidence.

Failure to Mediate

No party may commence any court action or arbitration with respect to any dispute under these Terms until they have first attempted to resolve the matter through mediation as provided herein, unless the party would be prejudiced by waiting for the completion of the mediation process.

Limitation of Liability

In no event shall Empowered Mind LLC, its officers, directors, employees, agents, licensors, or suppliers be liable for any direct, special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of profits, business interruption, loss of information, physical or emotional injury, or any other pecuniary loss) arising out of or related to:

The use of or inability to use the ServiceAny coaching advice, recommendations, or strategies provided through the ServiceAny actions you take or do not take based on information received through the ServiceAny unauthorized access to or use of our servers and/or any personal information stored thereinAny bugs, viruses, trojan horses, or the like which may be transmitted to or through the ServiceAny errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any contentAny interaction between you and other users of the ServiceAny results or outcomes, whether direct or indirect, from using the Service

The foregoing limitations will apply whether such damages arise out of breach of contract, tort (including negligence), or any other theory of liability and regardless of whether such damages were foreseeable or company was advised of the possibility of such damages.

Class Action Waiver

You and Empowered Mind LLC agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. However, any dispute arising under or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida. You consent to the personal jurisdiction of such courts and waive any objection as to inconvenient forum.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under these Terms which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood, pandemic, or any other natural or man-made eventuality outside of our control.
